Terms of Service

The rules and responsibilities that apply when you access or use ClubStack.

Effective June 14, 2026

These Terms of Service govern your use of ClubStack websites, dashboards, and related services. By creating an account or using the service, you agree to these terms on behalf of yourself and, where applicable, your organization.

1. Acceptance and eligibility

You must be legally able to enter into these terms. If you use ClubStack for an organization, you represent that you have authority to act for that organization and bind it to these terms.

2. Accounts and organizations

You must provide accurate information, keep credentials secure, and promptly update account details. You are responsible for activity under your account and for assigning appropriate administrator permissions within your organization.

3. Acceptable use

You may not use ClubStack to break the law, infringe rights, mislead users, distribute harmful content, interfere with the service, gain unauthorized access, or send communications without required consent.

You are responsible for ensuring that elections, member data, forms, products, fees, and communications managed through your account comply with applicable rules and laws.

4. Payments and fees

Organizations decide the amount they want to collect from members, customers, voters, form respondents, or other payers. ClubStack is designed so organizations receive the amount they ask to collect, while applicable ClubStack platform fees, service charges, SMS charges, data charges, or other usage-based fees are shown separately, added where applicable, or described in the relevant dashboard, checkout flow, pricing page, invoice, or product screen.

There are currently no setup fees and no recurring subscription charges for organizations to create and use an organization account on ClubStack. Organizations only pay when they use paid services or process transactions where a fee applies.

For example, if an organization creates a payment link to collect GHS 100 from a member, the organization is meant to receive GHS 100. If a ClubStack platform fee applies, that fee may be shown separately or added to the payer's checkout amount so the organization still receives the amount it asked to collect. Separately, if the organization chooses to buy SMS credits, data bundles, or another ClubStack service, that service charge is paid for that specific service.

Payment processing is provided by third-party payment providers, mobile money operators, banks, card networks, or other financial service partners. Their terms, availability, account validation, transaction limits, network status, and final transaction decisions may apply.

Organizations are responsible for the accuracy of charges they create, the legality of collections they receive, refund obligations to members or customers, and any taxes, accounting, or reporting requirements that apply to their activities.

5. Settlement to organizations

ClubStack is built for instant or near-instant settlement where supported. We are actively working to make organization collections settle instantly wherever provider integrations allow.

ClubStack does not operate as a bank, wallet custodian, or deposit-taking institution for organization funds. Where a dashboard displays a balance, pending amount, transaction record, revenue figure, or settlement status, that display is for tracking, reconciliation, workflow, or provider-status purposes and does not mean ClubStack is holding organization funds as deposits.

Settlement timing may still depend on third-party payment providers, mobile money operators, banks, card networks, telecom networks, account validation, provider availability, failed transactions, provider-side reversals, or incorrect settlement details supplied by users. ClubStack is not responsible for delays, failed settlement, or misdirected settlement caused by third-party providers or inaccurate account information.

6. Refunds, reversals, and disputes

Organizations are responsible for refund decisions, member disputes, customer claims, product or service issues, and any obligations connected to payments they collect through ClubStack.

If a payment is refunded, reversed, disputed, charged back, marked unsuccessful, or corrected by a provider after initial confirmation, ClubStack may update the related transaction records, balances, revenue figures, receipts, affiliate earnings, or settlement records to reflect the provider's final transaction status. Any such correction reflects the underlying provider result and does not mean ClubStack is withholding organization funds.

Platform fees, SMS credits, data bundle purchases, sender ID submissions, and other ClubStack service charges may be non-refundable once used, submitted, processed, or delivered, except where ClubStack decides otherwise or applicable law requires a refund.

7. SMS, sender IDs, and other communications

You must have a lawful basis and any required consent before contacting recipients. You must identify your organization where appropriate and honor opt-out, privacy, and communication requirements.

You are responsible for the content, recipient lists, timing, purpose, and legality of messages sent through ClubStack. You may not send spam, fraudulent messages, impersonation messages, abusive content, illegal content, or communications that violate telecom, privacy, advertising, school, institutional, or community rules.

Sender ID approval, SMS delivery, data bundle fulfillment, and message status depend on third-party gateways, telecom networks, and provider rules. ClubStack may reject, pause, or remove sender IDs or communications that appear misleading, unlawful, abusive, fraudulent, or likely to harm recipients, providers, or the platform.

8. Affiliate program

Affiliate commissions are calculated only from eligible ClubStack platform fees generated by organizations that register through a valid affiliate link or code and remain connected to that affiliate under the program rules.

Affiliates do not earn commission from organization funds, SMS purchases, data bundle purchases, wallet top-ups, settlement amounts, withdrawals, or other excluded ClubStack service purchases. Commission rates, eligible revenue types, payout thresholds, payout timing, and referral durations may be shown in the affiliate dashboard or program materials and may be updated by ClubStack.

ClubStack may withhold, reverse, adjust, or cancel affiliate earnings connected to refunded, reversed, disputed, failed, fraudulent, self-referred, abusive, or invalid transactions or referrals. Affiliates must not misrepresent ClubStack, create fake organizations, use deceptive promotion, or abuse the referral system.

9. Institutions and connected organizations

Where an organization joins, is created under, or is connected to an institution, that institution may be able to view or manage certain organization details, payment activity, approvals, SMS activity, withdrawals, performance records, or other dashboard information according to the permissions available in ClubStack.

Organizations and institutions are responsible for ensuring they have the authority, consent, and internal approvals required to connect accounts, view information, manage funds, approve actions, or use member and organization data.

10. Content and data

You retain ownership of content and data you submit. You grant ClubStack permission to host, process, transmit, and display that content only as needed to provide, protect, and improve the service.

You represent that you have the rights and permissions necessary to upload and use the content and personal information placed in ClubStack.

11. Service availability

We work to keep ClubStack reliable, but the service may occasionally be unavailable because of maintenance, network conditions, provider interruptions, security events, or circumstances outside our control. Features may change as the platform develops.

12. Suspension and termination

You may stop using ClubStack at any time. We may restrict or suspend access when reasonably necessary to protect the service, comply with law, address unpaid amounts, or respond to a material breach of these terms.

13. Disclaimers and limitation of liability

To the extent permitted by law, ClubStack is provided on an "as available" basis without warranties that are not expressly stated. ClubStack is not responsible for decisions made by organizations, member disputes, or third-party services.

To the extent permitted by law, ClubStack will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

14. Changes to these terms

We may update these terms to reflect service, business, or legal changes. Continued use after updated terms take effect constitutes acceptance where permitted by law.
